Rental agreement
The terms that govern a unit sitting on your job site.
Parties and equipment
This agreement is between Potty Pros LLC and the customer named on the order, covering the portable restroom units listed and delivered to the address on the order.
Ownership
All units remain the property of Potty Pros LLC at all times. This is a rental, not a sale. Units may not be sublet, sold, moved off the delivery site, or modified.
Term and billing
The term begins on delivery and continues until you request pickup. Rent is $150 per unit every 4 weeks, billed in advance. Payment arrangements are agreed with you when the rental is confirmed. Each billing period is a fixed 28 days, so there are 13 billing periods in a calendar year rather than 12. Rentals are billed in whole 4-week cycles; a unit collected part way through a cycle is not prorated. Delivery is $35 one time; pickup is included.
Placement and access
You choose the placement and confirm it is on level, stable ground with truck access, and that you have authority to place the unit there. Relocation on the same site is free; tell us or your driver. Units must remain accessible on service day.
Service
Included service is a weekly visit to pump, scrub, restock paper and sanitiser, and deodorise. Additional visits are $35 per unit.
Customer responsibilities
Do not place hazardous waste, construction debris, paint, solvents or trash in the unit. Cleaning charges apply for improper use. Keep the unit reasonably clear of equipment and vehicles.
Damage, loss and relocation by others
Normal wear is ours. You are responsible for the repair or replacement cost of damage from vandalism, tip-over, fire, theft, or being struck or moved by equipment. We photograph the damage and send you the amount before you are billed for it. Replacement cost of a total loss is $1,100 per unit.
Weather and wind
Units on open or elevated sites should be anchored. Ask us to anchor at delivery. Damage from unanchored units in high wind is the customer’s responsibility.
Indemnity
You agree to hold Potty Pros LLC harmless for injury or loss arising from the use, placement or condition of the unit on your site, except where caused by our negligence.
Termination
Either party may end the rental with notice. We may remove units for non-payment after written notice. Balances remain due.
Signature
Acceptance of delivery constitutes acceptance of these terms. A signed copy is available on request.
